Hire Your Realtor as you Would an Attorney or Home Inspector
Once you have interviewed several Realtors and found one that you like - HIRE THEM! The Consumer Protection Agency which governs the real estate industry in Connecticut, requires Realtors to have an authorized agreement to work on behalf of either the Buyer or the Seller. The only properties an agent may show you as the Buyer without an agreement, is their own listings and even then, they need to present you with documentation stating that they work on behalf of the Seller...NOT YOU! If they show you any other agency's properties, without a Buyer Broker agreement signed by you, they are breaking the law and could be reprimanded, fined or potentially lose their license. If they are willing to take this risk with their own career, how much more careful do you think they will be in representing you and handling your purchase contract? It may seem easier to just call the listing agent on a property, but in a large, financial transaction such as real estate, the foresight to get proper representation will always outweigh the hindsight of a mistake. Understanding Buyer Brokerage
Simply put, the Buyer Broker Agreement, usually a one page legal document stipulating the terms under which you are "hiring" your Realtor, creates a fiduciary relationship between you and the Realtor. While many Buyers think that it's just a way for a real estate agent to "bind" you to them, it actually represents more benefits to you as the Buyer. Representation is an entitlement and helps to diffuse the fear of "buyer beware" by having a licensed professional on your side. Of course, if the agent is not performing the duties as outlined in the agreement, it is up to the Buyer to notify the agent of your concerns and perhaps, the necessity of a mutual release. It is imperative that you, as a Buyer, understand ALL the terms of the Agreement and what you can expect from your Realtor.
